Terms of Service

BandUp provides AI-powered essay scoring and writing coaching for school writing and exam pathways, including NAPLAN, scholarship/selective entry, year-level advanced writing, state Year 12 pathways (VCE, HSC, QCE, WACE, SACE, TCE, NTCE), and custom rubrics. The service is provided by BandUp.

BandUp is an educational writing coach, not an official assessment service. Scores are estimates based on the selected rubric framework and should not be treated as official ACARA, VCAA, NESA, school-issued, ranking, or admissions results. NAPLAN® is a registered trademark of the Australian Curriculum, Assessment and Reporting Authority (ACARA). BandUp is not affiliated with ACARA.

No guarantee is made that use of BandUp will improve marks, bands, rankings, ATAR inputs, or exam outcomes. Exam-board names are descriptive references only and do not imply endorsement or affiliation.

BandUp accounts must be created by a parent or guardian aged 18 or over. You are responsible for:

• Providing accurate information about yourself and your child
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring your child uses the service appropriately
• Not representing BandUp outputs as official school, exam-board, or admissions decisions

You may register up to 3 child profiles per account on the Plus or Pro Max plan.

Parent plans: Air (free trial access), Plus (monthly), Pro (monthly), and Pro Max (annual). Feature access, student limits, and essay/rubric capabilities vary by plan as listed on our Pricing page.

Tutor plans: Air, Plus, and Pro with tutor-specific student caps and workflow entitlements as listed on our Teacher / Tutor pricing view.

Billing terms: Paid plans are billed in advance on the cadence selected at checkout (monthly or annual). Unless otherwise required by Australian Consumer Law, cancellations apply from the end of the current billing period and unused time is not partially refunded.

Current pricing, inclusions, and plan limits are published on the Pricing page and may be updated from time to time. All prices are in AUD and include GST where applicable. Payments are processed by Stripe, and BandUp does not store full payment card details.

Under the Australian Consumer Law, you are entitled to a refund if the service has a major failure. For other refund requests:

• Contact enquiries@bandup.com.au within 14 days of a charge
• Refunds are assessed on a case-by-case basis
• Trial periods are not refundable (there is no charge during the trial)
• Partial-month refunds are not available for monthly plans

You agree not to:

• Submit essays on behalf of a child who is not under your parental or guardian care
• Use BandUp to generate or submit essays for purposes other than your child's personal educational practice
• Attempt to reverse-engineer or misuse the scoring algorithm
• Share account credentials with others outside your household
• Submit offensive, illegal, or harmful content as essay text

BandUp uses Claude AI (Anthropic) to score essays. The scoring output — band scores, criterion scores, corrections, and feedback — is AI-generated and is provided for educational guidance only.

AI scoring may occasionally be inaccurate. We recommend using BandUp results as one input among several (including feedback from teachers) rather than as a definitive assessment of writing ability.

Essay corrections and feedback are generated by AI and do not constitute advice from a qualified teacher or education professional.

Essays submitted by students remain the intellectual property of the student (or parent/guardian). By submitting an essay, you grant BandUp a limited licence to process the essay text for the purposes of scoring and displaying results to you.

BandUp's platform, design, scoring prompts, and software are the intellectual property of BandUp and may not be copied or reproduced.

To the maximum extent permitted by Australian law, BandUp's liability for any claim arising from use of the service is limited to the amount you paid for the service in the 3 months prior to the claim.

Nothing in these terms limits or excludes any guarantees, warranties, or rights you have under the Australian Consumer Law that cannot be excluded.

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.

You may switch off promotional communications in your BandUp profile settings at any time. Service-related emails needed to deliver your account, results, billing, or legal notices may still be sent where required.
